Understanding the Air (Prevention and Control of Pollution) Act, 1981
The Air Act of 1981 was India’s first concrete legislative effort to address air pollution. Enacted by the Parliament of India, this law emerged following global environmental consciousness sparked by the United Nations Conference on the Human Environment held in Stockholm in June 1972. The Act’s primary objective is to prevent, control, and abate air pollution across the country. It defines key terms essential for understanding pollution control-including what constitutes an “air pollutant” (any solid, liquid, or gaseous substance present in concentrations harmful to living beings, plants, property, or the environment) and “air pollution” (the presence of such pollutants in the atmosphere).

The legislation establishes clear definitions for effective enforcement. “Control equipment” refers to any apparatus, device, or system used to control air pollutants, while “industrial plant” encompasses any plant used for industrial purposes that emits pollutants into the atmosphere. The Act establishes a two-tier regulatory structure comprising the Central Pollution Control Board (CPCB) and State Pollution Control Boards (SPCBs) to enforce environmental standards and monitor compliance.
Central Pollution Control Board
The CPCB, originally established in 1974 under the Water Act and later entrusted with air pollution control responsibilities, serves as the apex body for pollution management in India. Operating under the Ministry of Environment, Forest and Climate Change, the CPCB performs several critical functions. These include advising the Central Government on air quality improvement, planning nationwide pollution prevention programs, providing technical assistance to State Boards, and developing emission standards for various industrial categories.
The Board also establishes Minimum National Standards (MINAS) specific to various industries regarding effluent discharge, emissions, noise levels, and solid waste management. These standards serve as baseline requirements that State Governments must adopt and enforce.
State Pollution Control Boards
At the state level, SPCBs are responsible for executing comprehensive programs for pollution prevention within their jurisdictions. Their duties include advising state governments on pollution control matters, collecting and disseminating pollution-related information, inspecting air pollution control areas, assessing air quality, and taking corrective measures where necessary. The SPCBs work in collaboration with the CPCB to ensure uniform implementation of pollution control measures across India.
How air pollution affects food safety
The connection between air pollution and food safety is more significant than most people realize. Air pollutants damage crop yields and affect the nutritional quality and safety of food, posing substantial risks to food security.
Impact on crop yields and quality
Ground-level ozone (Oโ) is considered among the most damaging air pollutants affecting agricultural productivity. This pollutant forms when nitrogen oxides from vehicles and industrial emissions react with other air pollutants in sunlight. Research indicates that ozone causes yield losses of 5% to 12% globally in staple crops including wheat, rice, maize, and soybean, with associated economic losses estimated at up to $20 billion annually.
In India specifically, air pollution has been shown to cut wheat and rice yields significantly. Studies indicate yields between 1980 and 2010 were up to 36% lower than they would have been without air pollution trends. When ozone enters plants through leaf pores, it forms free radicals that attack cell membranes, causing visible damage such as yellowing, cell injury, and reduced flowering-all of which translate to lower food production.
Contamination of food products
Toxic particles from air pollution contaminate the ground when they settle, affecting soil quality and subsequently the crops grown in it. These pollutants don’t simply disappear-they remain in plants and animal products, eventually entering our food chain. Consumers may unknowingly ingest these contaminants, potentially facing health consequences that aren’t immediately apparent.
Particulate matter and chemical deposits on crops can alter their taste and texture. In regions with high air pollution, produce like leafy greens and fruits can absorb atmospheric pollutants, resulting in metallic or off-flavors. More concerning is the impact on nutritional value-elevated ozone levels can reduce crops’ ability to absorb nutrients, diminishing their vitamin and mineral content.
Effects on livestock
Air pollution’s impact extends beyond crops to livestock. Animals consuming contaminated water and forage accumulate pollutants in their bodies, which then make their way into meat and dairy products. Heavy metals like lead and cadmium can transfer through the food chain, ultimately reaching consumers and posing health risks.
Emission standards and monitoring mechanisms
To protect both public health and food safety, the Air Act establishes stringent emission standards for industrial plants. Beginning in 2000, India started issuing emission standards for 31 industrial categories, transforming the Act’s scope from general ambient air quality to specific industrial regulation.
Consent and compliance requirements
Under Sections 21 and 22 of the Act, industrial plants operating in designated air pollution control areas must obtain Consent to Establish (CTE) and Consent to Operate (CTO) from the relevant SPCB. These consents ensure that industries implement appropriate pollution control measures before commencing operations and continue to maintain compliance throughout their operational life.
The State Boards have the authority to inspect facilities, collect air samples, and monitor emissions to verify that industries meet prescribed standards. Industries failing to comply with emission standards face significant penalties, including imprisonment up to six years and daily fines until compliance is achieved.
National Air Quality Monitoring Programme
The National Air Monitoring Programme (NAMP) represents India’s systematic approach to assessing air quality status and trends. The program monitors pollutants through a network of stations operated by the CPCB, State Pollution Control Boards, and other agencies including the National Environmental Engineering Research Institute. Monitoring occurs 24 hours a day with specific sampling frequencies for gaseous pollutants and particulate matter, providing data essential for policy decisions and industrial siting.
Protecting food through pollution control
The intersection of air pollution control and food safety underscores why industries-particularly food processing facilities-must adhere to emission standards rigorously. When industrial emissions are properly controlled, the risk of contaminating nearby agricultural lands decreases significantly.
Implications for food processing industries
Food processing and manufacturing facilities must recognize their dual responsibility: preventing pollution from their own operations while protecting their products from external contamination. This requires investing in appropriate control equipment, regularly monitoring emissions, and maintaining compliance with all applicable standards under the Air Act.
Industries that fail to control their emissions not only face legal consequences but also contribute to a broader environmental problem that ultimately affects the quality and safety of food products-including potentially their own raw materials.
The path forward
Addressing air pollution’s impact on food safety requires coordinated action from regulators, industries, and agricultural stakeholders. The CPCB’s National Clean Air Programme (NCAP) aims to reduce air pollution by 20-30% in identified non-attainment cities, which would benefit both public health and agricultural productivity.
