The food you purchase from your local store or favorite restaurant undergoes rigorous checks before reaching your plate. In India, these checks are governed by a robust framework of regulations established under the Food Safety and Standards Act, 2006. This landmark legislation consolidated multiple food laws and created the Food Safety and Standards Authority of India (FSSAI) as the single regulatory body overseeing food safety across the nation. But what makes this system work are the detailed regulations that transform broad legislative goals into practical, enforceable standards.

The regulatory framework at a glance
The FSS Act, 2006 brought together several older laws-including the Prevention of Food Adulteration Act, 1954, Fruit Products Order, 1955, Meat Food Products Order, 1973, and others-under one unified framework. This consolidation eliminated regulatory overlap and created a streamlined system for food businesses and consumers alike.
Section 92(1) of the Act empowers FSSAI to make regulations consistent with the Act and rules. Following the Act’s enactment, six principal regulations were drafted through extensive stakeholder consultations. These regulations were notified in the Gazette of India on August 1, 2011, and came into force on August 5, 2011. Since then, additional regulations have been introduced to address evolving food safety needs, including those covering health supplements, nutraceuticals, organic foods, and food imports.
Food product standards and quality parameters
The Food Safety and Standards (Food Products Standards and Food Additives) Regulations, 2011 form the backbone of India’s food quality framework. These regulations establish science-based standards for virtually every category of food product-from milk and dairy items to cereals, oils, beverages, and processed foods.
What the standards cover
Each food category has specific quality parameters defined in the regulations. These include compositional requirements (minimum or maximum percentages of key ingredients), physical characteristics, and permissible processing methods. For instance, milk standards specify fat content requirements, while spice standards define moisture levels and essential oil content.
The development of these standards follows a rigorous process. After consideration by the Food Authority, draft standards are published for stakeholder comments. Since India is a signatory to the WTO-SPS Committee, draft standards are also notified internationally. Only after incorporating feedback are final standards published in the Gazette of India.
Food additives: what can be added and how much
Food additives serve various purposes-preserving freshness, enhancing flavor, improving texture, or adding color. However, their use must be carefully controlled to ensure consumer safety. The regulations provide comprehensive guidelines on permitted additives, categorized by their function: preservatives, antioxidants, colors, emulsifiers, stabilizers, and flavoring agents.
Each additive comes with specific usage limits for different food categories. For example, benzoic acid may be used as a preservative in fruit juices at levels not exceeding 120 parts per million. Sodium nitrite is permitted in cured meat products at no more than 200 parts per million. Certain additives are completely prohibited due to safety concerns.
Foods for infant nutrition face stricter restrictions-they must be free from preservatives, added colors, and artificial flavors. Only the additives specifically listed under infant food regulations may be used.
Contaminants, toxins, and residues: setting safe limits
Contaminants are substances not intentionally added to food but present due to environmental factors or processing activities. The Food Safety and Standards (Contaminants, Toxins and Residues) Regulations, 2011 establish maximum permissible limits for various contaminants to protect public health.
Heavy metals
Heavy metals like lead, arsenic, cadmium, and mercury can accumulate in food through environmental contamination. The regulations specify maximum limits based on food category. Lead levels must not exceed 2.5 mg/kg in certain processed fruits and vegetables. Arsenic limits are set at 1.0 mg/kg for certain seafood, while mercury cannot exceed 0.5 mg/kg in predatory fish species.
Pesticide and veterinary drug residues
The regulations control pesticide residue levels in agricultural products and veterinary drug residues in animal-derived foods. Maximum Residue Limits (MRLs) are prescribed for each pesticide-commodity combination. Certain antibiotics and pharmacologically active substances are completely prohibited in seafood processing.
Mycotoxins and natural toxins
Mycotoxins are toxic compounds produced by molds that can grow on various food commodities. The regulations establish limits for aflatoxins, ochratoxin A, patulin, and other mycotoxins in susceptible foods like grains, nuts, and dried fruits.
Packaging and labeling: informing consumers
The Food Safety and Standards (Labelling and Display) Regulations, 2020 replaced the earlier packaging and labeling regulations to provide more comprehensive consumer information requirements. These regulations prescribe labeling requirements for pre-packaged foods and display requirements for food business premises.
Mandatory label information
Every pre-packaged food must display specific information prominently. This includes the product name reflecting its true nature, complete list of ingredients, net quantity in weight or volume, manufacturer’s name and address, FSSAI license number, batch or lot number for traceability, and date markings including manufacture date and best-before or expiry dates.
Nutritional labeling requirements mandate disclosure of energy value, protein, carbohydrates, total fat, and other nutrients per 100g or per serving. If any nutrition or health claims are made, the relevant nutrient quantities must be declared.
Vegetarian and allergen declarations
A distinctive feature of Indian food labeling is the mandatory vegetarian/non-vegetarian declaration. Products must display a green symbol (filled circle in a square outline) for vegetarian items or a brown symbol (filled triangle in a square outline) for non-vegetarian products. Foods containing common allergens like cereals with gluten, crustaceans, eggs, fish, peanuts, milk, tree nuts, and sulphites must declare their presence.
Prohibited claims
The regulations prohibit false, misleading, or deceptive claims on labels. Therapeutic or medicinal claims suggesting that food can prevent, treat, or cure diseases are not permitted. Terms like “natural,” “fresh,” or “pure” cannot be used unless the product meets specific criteria defined by FSSAI.
Licensing, registration, and hygiene requirements
The Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011 establish the framework for food business authorization. All food business operators must either register or obtain a license depending on their scale of operations.
Schedule 4: the hygiene blueprint
A critical component of these regulations is Schedule 4, which introduces Food Safety Management Systems based on Good Manufacturing Practices (GMP) and Good Hygiene Practices (GHP). Every food business operator applying for a license must have a documented FSMS plan and comply with Schedule 4 requirements.
Schedule 4 is divided into five parts addressing different types of food businesses. Part I covers basic hygiene requirements for petty food operators applying for registration. Part II addresses general sanitary and hygiene practices for licensed food businesses. Parts III through V provide specific requirements for milk and dairy operations, slaughterhouses and meat processing units, and catering or food service operations respectively.
Key hygiene requirements
The regulations mandate proper facility design with adequate ventilation and lighting, pest control programs, potable water supply, and waste management systems. Personal hygiene requirements for food handlers include protective clothing, hand washing facilities, and health monitoring. Food businesses must maintain detailed records of cleaning schedules, pest control measures, and raw material sourcing.
Sampling, testing, and analysis procedures
Ensuring compliance with food safety standards requires systematic testing. The Food Safety and Standards (Laboratory and Sample Analysis) Regulations, 2011 establish procedures for food sampling, analysis, and laboratory operations.
Sample collection process
When Food Safety Officers collect samples for testing, they must follow specific protocols. Witnesses are called during sample collection, and proper documentation is maintained. Samples are divided into four parts-one sent for analysis, and three retained for potential appeals or verification.
Food business operators have the right to send one retained sample to a NABL-accredited or FSSAI-notified laboratory of their choice for independent testing. This provision ensures fairness and allows businesses to verify results.
Laboratory network and testing methods
FSSAI has established a network of referral laboratories, state laboratories, and notified private laboratories across India. Under Section 16(2)(f) of the Act, FSSAI specifies methods of analysis through detailed manuals covering different food categories-meat products, fish, dairy, cereals, spices, and more. A Method Review Group continuously reviews and validates testing methods to keep pace with scientific advances.
Continuous evolution: keeping pace with change
Food safety regulations are not static. They undergo periodic revision to incorporate latest developments in food science, changing consumption patterns, new food products and additives, advances in processing technology, and improved analytical methods. This dynamic approach helps bridge the gap between national and international standards.
Recent additions to the regulatory framework include the Food Safety and Standards (Organic Food) Regulations, 2017; the Food Recall Procedure Regulation, 2017; Import Regulations, 2017; and regulations governing health supplements, nutraceuticals, and novel foods. India’s alignment with Codex Alimentarius standards facilitates international trade while maintaining domestic food safety.
The comprehensive regulatory framework under the FSS Act has transformed India’s food safety landscape. From the farm to the fork, these regulations ensure that every step in the food supply chain meets defined safety and quality standards. For food businesses, compliance is not just a legal requirement-it’s a commitment to consumer trust and public health.
