When a food sample fails testing and someone disputes the result, where does the case go next? In India’s food safety framework, the answer lies with Central Food Laboratories (CFLs) – specialized facilities that serve as the final authority on contested food analysis. These laboratories form the backbone of appellate testing under India’s food safety laws, ensuring that disputes over food quality are resolved through rigorous scientific analysis.

What are Central Food Laboratories?

Central Food Laboratories are government-established facilities authorized under Section 4 of the Prevention of Food Adulteration Act, 1954 to carry out specialized food analysis functions. These laboratories were created to provide an independent, authoritative voice when food testing results are challenged in legal proceedings. Unlike primary testing labs that conduct routine food sample analysis, CFLs focus specifically on appellate cases where accuracy can determine legal outcomes.

The Director of a Central Food Laboratory holds significant statutory authority. This position is defined under Section 2(iv) of the PFA Act and carries the responsibility of issuing certificates that carry conclusive evidentiary weight in court proceedings. Importantly, anyone with financial interest in food manufacturing, import, or sale cannot be appointed as Director, ensuring impartiality in testing decisions.

The four Central Food Laboratories in India

India operates four Central Food Laboratories strategically located across the country. Each facility serves specific geographic regions, ensuring comprehensive coverage of the nation’s food safety needs.

Central Food Laboratory, Kolkata

The Kolkata laboratory, established in 1955, was India’s first Central Food Laboratory and has since been upgraded to National Food Laboratory status. It achieved a significant milestone in 2008 by becoming the first government food laboratory to receive NABL accreditation. This facility handles referral samples from Arunachal Pradesh, Assam, Chhattisgarh, Manipur, Meghalaya, Mizoram, Nagaland, Odisha, Sikkim, Tripura, Uttarakhand, and the Union Territories of Andaman and Nicobar Islands and Lakshadweep.

Food Research and Standardization Laboratory, Ghaziabad

Located in Indirapuram, Ghaziabad, this laboratory serves Bihar, Goa, Jharkhand, Madhya Pradesh, West Bengal, and the Union Territories of Dadra and Nagar Haveli, Daman and Diu, and Puducherry. The facility has been instrumental in standardizing testing methods and conducting research on food adulteration detection.

State Public Health Laboratory, Pune

The Pune facility, located at Cantonment Water Works Compound on Stavely Road, covers Andhra Pradesh, Delhi, Jammu and Kashmir, Karnataka, Kerala, Rajasthan, and Tamil Nadu. This strategic location allows it to serve both northern and southern regions of India effectively.

Food Safety and Analytical Quality Control Laboratory, Mysore

Operating within the CSIR-Central Food Technological Research Institute (CFTRI), the Mysore laboratory serves Gujarat, Haryana, Himachal Pradesh, Maharashtra, Punjab, Uttar Pradesh, and the Union Territory of Chandigarh. This facility is ISO 17025 certified and accredited for over 300 analytical parameters for chemical and biological food testing.

The appellate function: resolving disputed test results

The primary role of Central Food Laboratories is providing appellate analysis when food testing results are contested. Under Section 13(2) of the PFA Act, when a Public Analyst’s report indicates that a food sample is adulterated, the accused party has the right to request re-analysis by a CFL. This request must be made within ten days of receiving the initial report.

The process works as follows: the court requisitions the sample portion held by the Local Health Authority, which must forward it within five days. The court then verifies that seals and signatures remain intact before dispatching the sample to the appropriate CFL. The Director must provide a certificate specifying the analysis results within one month.

What makes CFL certificates particularly powerful is their legal standing. Section 13(3) of the PFA Act explicitly states that the certificate issued by the Director of the Central Food Laboratory supersedes the report given by the public analyst. Court proceedings remain suspended until the CFL certificate is received, underscoring the importance of these findings.

Analysis of imported food products

Beyond appellate testing, CFLs play a critical role in analyzing imported food articles under Section 6(2) of the PFA Act. When Customs officers suspect that an imported food package may violate food safety standards, they can detain the package and forward it (or samples from it) to the Central Food Laboratory for analysis.

This function is essential for protecting consumers from potentially unsafe imported foods. The CFLs examine imported products for compliance with Indian food standards, checking for adulteration, contamination, and proper labeling. Their findings directly influence whether imported food consignments are released or rejected at ports of entry.

Functions beyond testing

Central Food Laboratories perform several additional functions that strengthen India’s overall food safety infrastructure. According to FSSAI’s Laboratory and Sample Analysis Regulations, referral laboratories are responsible for:

Standards development: CFLs investigate food samples to help establish quality standards for various food articles. This research-based approach ensures that food standards remain scientifically grounded and relevant.

Method standardization: The laboratories collaborate with state-level Public Analyst laboratories and other approved institutions to standardize testing methodologies. This ensures consistency in how food samples are analyzed across the country.

Quality assurance: CFLs maintain high standards of accuracy, reliability, and credibility in laboratory operations. They work toward achieving and maintaining required accreditation levels.

Capacity building: These facilities organize professional training, workshops, and seminars for food analysts and laboratory personnel in their designated regions.

Transition to the modern framework

While the Prevention of Food Adulteration Act, 1954 established the original Central Food Laboratory system, India’s food safety landscape has evolved significantly. The Food Safety and Standards Act, 2006 established FSSAI as the apex regulatory body, bringing all food-related matters under unified oversight.

Under the current framework, the original CFLs continue operating as Referral Food Laboratories within FSSAI’s expanded network. FSSAI has now notified 22 referral laboratories across India, though the four original CFLs remain central to the system. The authority has created a network of 232 laboratories to fulfill its food testing and analysis mandate.

FSSAI has also developed InFoLNet, a laboratory management system that connects and categorizes laboratories on a fit-for-purpose basis – distinguishing between facilities suited for regulatory requirements, routine testing, and appellate testing.

Ensuring accuracy in high-stakes situations

The importance of CFL findings cannot be overstated. In food adulteration cases, courts have consistently held that accused persons have a valuable and mandatory right to have their samples analyzed by the Central Food Laboratory. Denial of this right – whether through excessive delays or sample deterioration – can constitute prejudice to the accused and may result in acquittal.

The Supreme Court has clarified that mere delay does not automatically invalidate prosecution cases if the sample remains fit for analysis. However, if a sample becomes unfit for analysis due to time passage or prosecutorial lapses, the accused’s right stands denied, potentially compromising the entire case.

This high-stakes environment demands that CFLs maintain exceptional standards. Their certificates serve as final and conclusive evidence in court proceedings, making accuracy not just a quality goal but a legal necessity.

The continuing relevance of CFLs

Despite modernization of India’s food safety framework, Central Food Laboratories remain essential. They provide the independent verification needed when routine testing faces challenge, offer specialized expertise for complex import cases, and support the broader food safety ecosystem through research and training.

The Food and Drug Capacity Building Project, implemented from 2003 to 2008 with World Bank assistance, invested approximately Rs. 320 crore to strengthen laboratory capacity at central and state levels. This investment recognized that effective food safety enforcement depends on robust laboratory infrastructure.

As India’s food industry grows and diversifies, these laboratories face increasing demands. Their role in maintaining consumer confidence and supporting fair legal processes ensures they will remain vital components of India’s food safety architecture for years to come.
