Insecticides play a vital role in protecting food crops from pests, but their use must be carefully regulated to prevent health risks for consumers and environmental harm. In India, this regulatory oversight is primarily governed by The Insecticides Act, 1968, a landmark legislation that controls everything from manufacturing to the application of pesticides on food crops. Understanding this regulatory framework is essential for anyone involved in food production, quality assurance, or food safety compliance.

The Insecticides Act, 1968: an overview
The Insecticides Act was enacted by the Indian Parliament in 1968 to regulate the import, manufacture, sale, transport, distribution, and use of insecticides. The primary objective of this legislation is to prevent risks to human beings and animals that may arise from the improper handling or application of these chemical substances.
The Act extends to the whole of India and applies to all insecticides, which under the law include not just substances targeting insects, but also fungicides and weedicides used in agricultural practices. A key aspect of the Act is that its provisions work alongside other existing laws rather than replacing them, creating a comprehensive legal framework for pesticide regulation.
Under this Act, no person can import, manufacture, sell, stock, exhibit for sale, or distribute any insecticide that is misbranded, banned, or not registered. Violations can result in imprisonment of up to two years and fines for first-time offenders, with penalties increasing for subsequent offences.
Central Insecticides Board: the advisory body
One of the most significant provisions of the Act was the establishment of the Central Insecticides Board (CIB). This body serves as the primary advisory authority to both Central and State Governments on all technical matters related to insecticide administration.
The Board’s advisory responsibilities include assessing the risk to human beings and animals from insecticide use and recommending safety measures to prevent such risks. It also advises on matters related to the manufacture, sale, storage, transport, and distribution of insecticides to ensure safety standards are maintained throughout the supply chain.
The CIB has a broad membership structure that includes the Director-General of Health Services (who serves as Chairman), the Drugs Controller of India, the Plant Protection Adviser to the Government of India, and representatives from various relevant ministries and research institutions. This diverse composition ensures that decisions are informed by multiple perspectives, including health, agriculture, and environmental considerations.
The Registration Committee
Working alongside the CIB is the Registration Committee, which performs the crucial function of registering insecticides before they can be legally sold in India. This committee scrutinises the formulae of insecticides and verifies claims made by importers or manufacturers regarding their efficacy and safety to human beings and animals.
The registration process involves rigorous evaluation of safety data, field trial results, and toxicity assessments. Any person wishing to import or manufacture an insecticide must apply to the Registration Committee, with separate applications required for each insecticide product.
Licensing and enforcement mechanisms
The Act establishes a multi-tiered enforcement system. State Governments appoint Licensing Officers who grant licences to those wishing to manufacture, sell, stock, or distribute insecticides. Anyone desiring to engage in commercial pest control operations must also obtain appropriate licensing.
Insecticides Inspectors are appointed by both Central and State Governments with powers to enter and search premises, stop the distribution or sale of insecticides being used in contravention of the Act, and take samples for analysis. The Central Insecticides Laboratory provides technical support by analysing samples and providing expert reports that can be used in legal proceedings.
Banned and restricted pesticides
Over the years, the Expert Committee has evaluated numerous pesticides and taken action against those found to be harmful to human health or the environment. As of March 2024, several categories of pesticides face regulatory restrictions in India.
Completely banned pesticides include substances like aldrin, dieldrin, endrin, chlorobenzilate, and dibromochloropropane (DBCP). These pesticides have been prohibited for manufacture, import, and use due to their proven health hazards, including carcinogenicity, endocrine disruption, and environmental persistence.
Some pesticides, like nicotine sulphate and captafol 80% powder, are banned for use within India but their manufacture is permitted for export purposes. Additionally, several pesticides have been refused registration due to safety concerns, effectively preventing their legal use in the country.
Restricted use pesticides
Certain pesticides are allowed under strict limitations. For example, aluminium phosphide can only be used by government-approved pest control operators. Captafol is banned as a foliar spray but permitted as a seed dresser. DDT use is restricted exclusively to vector control in public health programmes. Monocrotophos, while registered, is banned for use on vegetables due to residue concerns.
Pesticide residue limits in food
While the Insecticides Act regulates pesticide production and use, the Food Safety and Standards Authority of India (FSSAI) sets the maximum residue limits (MRLs) for pesticides in food commodities. These MRLs represent the highest level of pesticide residue legally permitted in food products.
The Food Safety and Standards (Contaminants, Toxins and Residues) Regulation, 2011 specifies MRLs for various pesticide-food combinations. These limits are established based on field trial data received through the Central Insecticides Board and Registration Committee. The goal is to ensure that even if pesticide residues remain on food after harvest, they are at levels considered safe for human consumption.
Monitoring and compliance
The Central Government monitors pesticide residues through the Monitoring of Pesticide Residues at National Level (MPRNL) scheme. Participating laboratories collect and analyse food samples from markets across the country to check for pesticide contamination. When residues exceed FSSAI MRLs, enforcement actions can be taken against responsible parties.
The MRL framework considers both the toxicity of pesticides and their breakdown products, application rates and frequency, and how much residue typically remains by the time food reaches consumers. For pesticides where Indian data is unavailable, standards established by the Codex Alimentarius Commission may be applied.
Implications for food safety
The regulatory framework created by the Insecticides Act and complementary food safety regulations serves multiple purposes in protecting public health. It ensures that only registered, evaluated pesticides can be used on food crops, that application follows prescribed guidelines, and that residue levels in marketed food remain within safe limits.
For food businesses, compliance with these regulations is mandatory. This includes sourcing from suppliers who use registered pesticides appropriately, maintaining documentation of pesticide use in agricultural inputs, and ensuring that finished products meet MRL requirements. Non-compliance can result in product seizure, penalties, and damage to brand reputation, particularly in export markets where standards may be even stricter.
The framework continues to evolve as new scientific evidence emerges about pesticide safety. Regular reviews by expert committees lead to updates in the list of banned, restricted, or permitted substances. Food safety professionals must stay current with these changes to ensure ongoing compliance and protection of consumer health.
